Policy on Digital Millennium Copyright Act

Greetings to all visitors of this website (referred to as the ‘Site’). We highly value the intellectual property rights of individuals just as we expect others to value ours. In accordance with the Digital Millennium Copyright Act, Title 17 of the United States Code, Section 512(c), a copyright owner or their designated representative may issue a takedown notice to us using the contact details of our DMCA Agent listed below. As a provider of internet services, we are eligible to claim immunity from accusations of copyright infringement under the safe harbor provisions of the DMCA. To file a genuine claim of copyright infringement with us, you must issue a notice containing the following details:

Notification of Infringement – Claim

  1. A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf);
  2. Identification of the copyrighted work believed to have been infringed;
  3. Details identifying the infringing material that needs to be taken down, along with information allowing us to locate the material. [Please include the URL of the relevant page to aid in identifying the allegedly offending content];
  4. Information enabling us to contact the complainant, including their name, physical address, email address, phone number, and fax number;
  5. A statement from the complainant indicating their good faith belief that the use of the material is not authorized by the copyright owner; and
  6. A statement verifying the accuracy of the information provided in the notification and a declaration, under penalty of perjury, that the complainant is authorized to act on behalf of the copyright owner.

Section 17 USC §512(f) outlines penalties for civil damages, including expenses and legal fees, for individuals who knowingly and significantly misrepresent information in an infringement notification under 17 USC §512(c)(3).

Kindly send all takedown notices via our Contact page. For prompt attention, we suggest using email.

Please be aware that we may disclose the identity and information contained in any copyright infringement claim we receive to the accused infringer. By submitting a claim, you acknowledge, agree, and consent to the communication of your identity and claim to the purported infringer.

Counter Notification – Restoration of Material

If you have been notified that material is being removed due to a copyright infringement allegation, you have the option to provide us with a counter notification to attempt to have the material reinstated on the site. This notification must be submitted in writing to our DMCA Agent and must contain the following key elements as per 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material that was removed and its original location before removal.
  3. A statement, under penalty of perjury, affirming that you believe the material was taken down as a result of an error or misidentification.
  4. Your name, address, and telephone number, along with a statement consenting to the jurisdiction of the federal district court in the district where your address is located (or, if you are outside the US, in any jurisdiction where the service provider can be found), and agreeing to accept service of process from the entity that issued the original infringement notification.

Submit your counter notification through our Contact page, with email being the preferred method of delivery.

Repeat Infringer Policy

We treat copyright infringement with utmost seriousness. In line with the repeat infringer policy stipulations of the Digital Millennium Copyright Act, we maintain a record of DMCA notices from copyright holders and put in reasonable efforts to identify any repeat infringers. Accounts of individuals who violate our internal repeat infringer policy will be terminated.
